YOUR TRUSTED ATTORNEY IN GEORGIA WITH
THE COURAGE TO FIGHT FOR YOU
Joshua J. Smith is a trial attorney committed to practice in the United States Supreme Court, 11th Federal Circuit Courts, Georgia Supreme Court, and the Appellate and trial courts of the State of Georgia.
The Court System
The federal court system has three main levels:
- District courts, also called the trial court,
- Circuit courts which are the first level of appeal, also known as the court of appeals or the appellate court, and
- the Supreme Court of the United States, the final level of appeal in the federal system.
In the federal court system’s present form, 94 district-level trial courts and 13 courts of appeals sit below the Supreme Court, the highest court of the United States. The 11th Federal Circuit Court is one of the 13 appellate courts that sit below the U.S. Supreme Court. The 13 appellate courts are called the U.S. Courts of Appeals.
Also, there are 94 federal judicial districts that are organized into 12 regional circuits, each of which has a court of appeals. The appellate court’s task is to determine whether the law was applied correctly in the trial court. Appeals courts consist of three judges and do not use a jury.
District Courts
The nation’s 94 district or trial courts are called U.S. District Courts. District courts resolve disputes by determining the facts and applying legal principles to decide who is right. District/trial courts include the district judge who tries the case and a jury that decides the case.
Attorney Joshua J. Smith Represents Clients in Three Main Areas of Law:
Our law firm works for justice and fairness in three main areas at each level of the court system:
Attorney Smith represents clients who have been charged with a crime and offers a rigorous defense. He also handles appeals for cases that lost at the district court level and presents their petition requesting an overturning of the lower court’s decision to the appellate court.
He also litigates on behalf of clients who have been injured or harmed and are pursuing needed and fair compensation for their loss. This can include medical bills, ongoing costs of rehabilitation, loss of wages or livelihood, and property loss. The ultimate civil litigation is wrongful death when the loss of life is a result of negligence or reckless disregard for others in pursuit of personal actions or behavior.
He and his dedicated staff work hard to fully represent their client’s position and, in the case of criminal court, their defense, to the court. The goal is to successfully litigate a positive outcome and to ensure the rights of his clients are respected and upheld.
